Victory for Life! ACLU Drops Challenge to Kentucky’s Pro-Life Laws

LEXINGTON, KY – On Friday, May 30, the ACLU filed a voluntary dismissal of their challenge to Kentucky’s Human Life Protection Act and Heartbeat Bill, pro-life laws that protect preborn children from the evil scourge of abortion. The ACLU did not provide a reason and stated that healthcare decisions would remain private.

This is the fourth time a lawsuit has failed to overturn Kentucky’s pro-life protections since the Dobbs decision overturned Roe v. Wade in 2022. In 2023, the Kentucky Supreme Court ruled that abortion facilities did not have proper standing to bring a lawsuit challenging the laws. And a previous ACLU challenge to Kentucky’s pro-life protections was voluntarily dismissed at the end of 2023.

“We are thankful to the Lord for the news that this latest pro-abortion challenge to Kentucky’s laws protecting preborn life has been dismissed. All human life is worthy of protection, and Kentucky’s pro-life laws reflect that fundamental truth.

“Pro-life Kentuckians should celebrate this victory and be thankful for the important laws passed by the General Assembly and defended by our Attorney General. We must also remain steadfast against future attempts to bring the abortion mills back to Kentucky, whether through judicial activism or through legislating anti-life exceptions. The Family Foundation will continue to advocate for stronger laws that protect human life from destruction, including working to stop the growing proliferation of chemical abortion pills that are still killing preborn children in Kentucky,” Walls concluded.

The Family Foundation proudly supported the Human Life Protection Act (HB 148) and the Heartbeat Bill (SB 9) in 2019. The Family Foundation also supported HB 90 passed earlier this year, which provides important pro-life and pro-mom clarifications to the Human Life Protection Act.

With the dismissal of this latest lawsuit, there is no active legal action challenging the constitutionality of Kentucky’s pro-life laws and every word of the Commonwealth’s life-saving laws protecting preborn Kentuckians remains in full effect.
