Texas Ban on Drag Shows for Kids Upheld by 5th Circuit

On June 18, 2023, Texas Governor Greg Abbott signed into law Senate Bill 12, the “Ban on Drag Queen Shows for Kids Bill.” This law gives Texas officials the authority to regulate sexually oriented performances by not allowing drag shows on public property or in the presence of kids.

Not surprisingly, just a couple of months later, the ACLU and other pro-LGBTQ organizations filed a lawsuit against the law. In late September of 2023, a Houston Judge blocked the law from going into effect by issuing a permanent injunction against it.

Erroneously, the Houston Judge stated that the law unconstitutionally restricted free speech, violating the First Amendment. After the ruling was appealed, the 5th Circuit Court of Appeals intervened to temporarily lift the lower court’s order halting SB 12, thus giving Texas the go-ahead to enforce the law.

Just days ago, praise be to God, a panel of the 5th Circuit reaffirmed its November ruling that Texas can protect minors from sexually oriented performances, including drag shows, and regulate them on public property. The 5th Circuit got this one absolutely right. Children are vulnerable and impressionable, and they do not need to be preyed on by those wanting to influence their minds and promote immorality with hypersexualized drag shows.

The reality is, there is absolutely no constitutional right for drag queens, or anyone else, to target our children and attempt to “sexualize” them. Thankfully, children in Texas will be protected from those who want to put on sexualized performances targeting kids, as it is now an enforceable criminal offense. In 2024, the Kentucky Senate passed legislation similar to the Texas law, but the Kentucky House did not allow a vote on the legislation. This legislative session, the Kentucky General Assembly, once again, has an opportunity protect our kids and tax dollars from sexually explicit drag shows with HB 360 by Rep. Scott Sharp.

For our “Let Us Pray” devotionals during the 2026 KY General Assembly, we will be taking time during the legislative session to encourage you to pray, by name, for our elected leaders (see below). Let us commit to praying regularly for our Kentucky governmental leaders to act in ways that bring honor and glory to Jesus Christ and are a blessing to our Commonwealth.

LET US PRAY…

Father, we praise You for this correct and righteous ruling by the 5th Circuit Court of Appeals to protect minors in Texas from sexually oriented drag show performances. Lord, may Kentucky and other states across our nation work to implement similar laws to protect American children from targeted “sexualization.” Father, help us to effectively protect the youth of our nation from being influenced by the path of immorality. In Jesus’ Name, Amen.
