During the 2025 KY General Assembly, The Family Foundation supported Senate Bill 2, which bans taxpayer-funded gender “transitions” for prisoners. The bill was passed by the KY House with a vote of 73-12 and by the KY Senate with a vote of 31-6. The bill became law when Governor Beshear simply did not take action on it. The necessity of SB 2 came about after the General Assembly uncovered internal policies from Beshear’s Department of Corrections that created a process for prisoners to receive taxpayer-funded “transitions.”
In July, the ACLU filed a lawsuit against Senate Bill 2 on behalf of a convicted murderer who is a biological male but falsely claims to be a “female.” The inmate, Matthew Marcum, is imprisoned at the Northpoint Training Center in Boyle County, KY, and unbelievably, he had been receiving cross-sex hormone therapy while being in prison for several years.
The suit specifically targets Senate Bill 2 by requesting a meritless injunction on the law, which would block it from being in effect in Kentucky. The lawsuit’s arguments are that Senate Bill 2 violates the Eighth Amendment, which prohibits cruel and unusual punishment, and the Fourteenth Amendment, which guarantees equal protection rights.
Thankfully, right now, because of Senate Bill 2, Marcum is not receiving taxpayer-funded hormone “therapy.” Praise be to God, days ago, the U.S. Court of Appeals for the Sixth Circuit considered the lawsuit and declined to block Senate Bill 2, leaving the important law in place and in effect.
This lawsuit exemplifies how out of touch the ACLU is by pushing its radical, far-left agenda here in Kentucky. It is a joyful and settling feeling knowing that our hard-earned tax dollars are not going to fund fictional and harmful “transition” procedures for convicted inmates.

Father, we praise You for this righteous ruling from the U.S. Court of Appeals for the Sixth Circuit. Lord, please continue to strengthen Kentucky Attorney General Russell Coleman and his team as they defend this important law. Father, please protect our hard-earned tax dollars from going to fund things that are against Your Word. In Jesus’ Name, Amen.
