Abortion Death Pill Case Heard by Fifth Circuit

The United States Fifth Circuit Court of Appeals recently heard oral arguments in the case of Louisiana v. FDA. In October of 2025, Louisiana filed a lawsuit against the U.S. Food and Drug Administration (FDA) to stop them from allowing mail-ordered abortion death pills.

The Biden Administration opened the door to this by removing the longstanding requirement that these death pills had to be dispensed in person at a medical facility. The Trump Administration has not taken any action to reverse this and because of that, these death pills continue be mailed directly to individuals without seeing a physician or even proving their identity. Louisiana claims this has led to an influx of abortion death pills into the state, violating its pro-life laws. The same is no-doubt true for Kentucky.

Sadly, at the oral arguments, Attorney General Morrill’s team was met with a cold response from the Fifth Circuit panel. The panel seemed skeptical of their arguments and voiced hostile opposition to Attorney General Morrill’s team. The three-judge panel did not indicate when it would rule on the case. The case could very well ultimately reach the U.S. Supreme Court.

U.S. Health and Human Services Secretary Robert F. Kennedy Jr. and FDA Commissioner Marty Makary stated that the FDA will conduct “its own review of the evidence, including real-world outcomes and evidence, relating to the safety and efficacy of the drug.”

The FDA’s allowance of these mail-ordered abortion death pills has had significant consequences. Homes have become abortion mills, state laws have been violated, babies have been killed, and woman have been harmed. If the Trump Administration wants to protect families and uphold states’ rights, then they must act now.

Father, please enlighten the U.S. Court of Appeals for the Fifth Circuit to see the right position of Louisiana and rule accordingly. Lord, please empower the Trump Administration to act swiftly to protect women and the unborn from the deadly abortion drug. Father, may we never grow weary in the righteous battle to stand for truth.
